They are not legally mandatory but strongly recommended. An e-commerce site must have both, or merged General Terms.

Yes. Your legal documents must be updated with each change: modification of legal status, change of address or capital, host change, new activity (becoming e-commerce), or major legislative change. SREN law 2024 made all legal notices created before May 2024 obsolete. Check your documents at least once a year.

SREN law of May 21, 2024 (Secure and Regulate Digital Space) adds a new obligation to legal notices: you must now identify the data storage provider (cloud provider) if different from the site host. For example, if your site is hosted at OVH but your data is on AWS or Google Cloud, you must mention both. This is article 1-1, 5° of amended LCEN.
